What Is Sexual Harassment?

Sexual harassment is a form of sex discrimination in the workplace. It entails unwelcome physical or verbal sexual advances and the implication that the victim’s refusal of these advances would negatively impact his or her employment, work performance, or work environment. There are two types of sexual harassment claims. Quid pro quo claims are based on cases in which the victim’s superior requests a sexual relationship with the victim in exchange for favors (e.g., raises) or the withholding of punishment (e.g., permanent dismissal). Hostile work environment claims are based on cases in which a colleague or superior creates an intimidating or hostile work environment by telling sexual jokes, displaying sexual photographs, or by making sexual comments or threats.
