Whistleblower Appreciation Day

In honor of National Whistleblower Appreciation Day (July 30th), we want to highlight the legislative safeguards and protections for patients, healthcare workers, nurses, members of medical staff make a complaint of suspected unsafe patient care and/or conditions. California Health & Safety Code Section 1278.5 makes it illegal for a health facility to discriminate or retaliate in any manner against a patient, employee, or any other healthcare worker because that person presented a grievance, complaint or report about the facility or initiated, participated or cooperated in an investigation or administrative proceeding relating to the quality of care, services or conditions at the facility.

Similarly, under California Health & Safety Code Section 1432, no long-term care facility (nursing home) shall discriminate or retaliate in any manner against a complainant, patient, or employee for the reason that the complainant, patient, or employee presented a grievance or complaint or initiated an investigation or inspection of the facility.
