Bill AB1572 Strengthens The Rights Of Residential Care Facility Residents
AB1572 was just signed into law by Governor Brown. AB1572 strengthens the rights of RCFE residents and their families to form resident and family councils. Resident and family councils are a powerful tool to improve the quality of life and care in RCFEs. This new legislation provides that two or more residents can now form a resident council, whereas it used to take a majority. Further, providers must inform both residents and families of their right to form councils. Finally, this new law also requires providers to respond to written requests or concerns of councils within 14 days and are prohibited from interfering in the formation, maintenance of councils. A provider that attempts to interfere with the formation, maintenance or promotion of council could be the subject of a citation and a civil penalty of $250 per day. This AB1572 will take effect on January 1, 2015.
